Legal & Governance Protection Framework

A strategic legal, governance, operational, intellectual-property, branding, and compliance framework for The Malhotra Method (TMM) — the standard against which all public and commercial activity is run.

1. Foundational Positioning

TMM is positioned as an educational and strategic framework focused on discipline, systems, leadership, and structured decision-making. It is not financial, legal, medical, or therapeutic advice, and is never marketed as a guarantee of outcomes. All messaging reflects this positioning.

2. Intellectual Property Ownership

All writings, logos, frameworks, SOPs, audio, video, and training materials are archived with verifiable timestamps. A central IP register records the author, creation date, and ownership of each asset so provenance can be evidenced at any time.

3. Trademark Strategy

"The Malhotra Method" and associated branding are registered as trademarks in key jurisdictions, with a watch service to detect and challenge infringement. Registration precedes any expansion into a new market.

4. Copyright Protection

Secure, access-controlled archives are maintained for all published and unpublished content. Copyright notices are applied to materials, and licensing of any content is governed by formal agreement.

5. Corporate Structure

Intellectual-property ownership is held separately from operational trading activity, so that core IP is ring-fenced from operational liability. Structure is reviewed with professional advisers as the organisation grows.

6. Terms of Use

All public platforms carry clear terms, disclaimers, and privacy notices. Users must be able to find the terms that govern their use before they engage.

7. Privacy & GDPR

User information is protected under UK GDPR-compliant systems, with lawful bases, retention limits, and data-subject rights operationalised through the Privacy Policy and Data Retention Policy.

8. Defamation & Commentary

Public commentary is held to an evidence-based standard. Statements of fact are supported by records; opinion is clearly framed as opinion. This protects against defamation exposure while preserving honest commentary.

9. Financial Conduct

No guaranteed wealth or profit claims are made, anywhere. Any reference to results is accompanied by appropriate context and the Disclaimer. Regulated financial promotions are avoided unless properly authorised.

10. Political Separation

Personal or party political support is kept separate from the institutional and commercial branding of TMM. The brand does not endorse parties or campaigns.

11. AI Governance

AI disclosure notices and moderation systems are used wherever AI contributes to content or interaction, in line with the AI Usage Policy. Outputs affecting people are reviewed by a human.

12. Human Development Ethics

TMM does not use coercive, manipulative, or high-pressure behavioural systems. Development methods are transparent, consensual, and respect participant autonomy and wellbeing, consistent with the Safeguarding Policy.

13. Certification Systems

14. Media Risk

Interviews, public content, and publications are archived. Pre-publication review is applied to higher-risk material, and a record is kept of what was said, where, and when.

15. International Expansion

Local legal, tax, data-protection, and consumer obligations are reviewed before entering any new jurisdiction. Trademark and structure are confirmed in advance.

16. Community Governance

Fraud, hate speech, harassment, and illegal activity are prohibited across all communities and channels, enforced through the Community Rules.

17. Licensing

Brand and content licensing is only ever granted under a formal written Licensing Agreement with quality, vetting, and termination controls.

18. Reputation Management

Communications are disciplined and factual. The brand voice is calm, precise, and consistent with the Brand Usage Guidelines; reactive or inflammatory communication is avoided.

19. Record Keeping

Contracts, archives, and compliance documentation are maintained, version-controlled, and retained per the Data Retention Policy, so that any obligation or claim can be evidenced.

20. Crisis Protocol

Defined procedures exist for legal complaints and PR incidents: a named lead, a holding response, escalation thresholds, and a single source of truth. Incidents are logged and reviewed. This aligns with the Complaints & Escalation Policy.

21. Long-Term Governance

Succession structures are established for continuity of ownership, decision-making, and IP stewardship, so the framework outlasts any single individual.
