This Agreement is entered into between Bernardine Ltd and the participant (or their parent/guardian) upon enrolment in the Programme. It sets out the commitments of both parties.
1. Parties
This Agreement is made between Bernardine Ltd ("the Provider") and the named Participant. Where the Participant is under 18, it is co-signed by their parent or legal guardian ("the Guardian"), who accepts these terms on the Participant's behalf and warrants their authority to do so.
2. The Programme
The Provider will deliver the Programme as described in the enrolment materials, including scheduled sessions, mentoring, structured routines, and supporting materials. The Provider may reasonably adjust the schedule or content to improve outcomes or to meet safeguarding and legal requirements.
3. Participant Commitments
- Attend scheduled sessions punctually and engage fully.
- Follow the Daily SOP Manual and Digital Discipline SOP.
- Abide by the Community Rules and treat others with respect.
- Provide accurate information at enrolment and update it if it changes.
- Complete tracking and progress records honestly.
4. Provider Commitments
- Deliver the Programme with reasonable care and skill.
- Provide a safe environment in line with the Safeguarding Policy.
- Handle personal data per the Privacy Policy.
- Provide a fair route to raise concerns under the Complaints & Escalation Policy.
5. Fees and Payment
Fees, payment schedule, and any instalment arrangement are recorded at enrolment. Where the Programme is delivered free under a council/government pilot, no participant fee applies. Non-payment of agreed fees may result in suspension.
6. Cancellation
Consumers may cancel within 14 days of signing under the Consumer Contracts Regulations 2013, subject to a deduction for Services already provided where delivery was requested to begin within that period. After the cohort commences, fees are non-refundable except at the Provider's discretion or where required by law.
7. Conduct and Removal
The Provider may suspend or remove a Participant for serious or repeated breach of the Community Rules, unlawful conduct, or behaviour that endangers others. Removal for cause does not entitle the Participant to a refund.
8. Media and Likeness
Photography or recording for promotional use only takes place where separate consent has been given on the Consent Form. Consent can be withdrawn at any time.
9. Confidentiality
Participants must keep confidential any proprietary materials and the personal information of other participants, in line with the NDA / Confidentiality Agreement.
10. Governing Law
This Agreement is governed by the laws of England and Wales.
